SHOP ISRAELLA TERMS OF SERVICE

OVERVIEW

This website is operated by Shop Israella ("Shop Israella," "we," "us," or "our"). By accessing our website, purchasing products, subscribing to marketing communications, participating in promotions, or otherwise using our services, you agree to be bound by these Terms of Service.

SECTION 1 – ONLINE STORE TERMS

You represent that you are at least the age of majority in your state of residence or have obtained the consent of a parent or legal guardian. You may not use our products or services for any unlawful purpose.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone at any time for any lawful reason. We may limit, suspend, or terminate access to the Site if we believe these Terms have been violated.

SECTION 3 – PRODUCTS, INVENTORY & PRICING

All product descriptions, pricing, promotions, and availability are subject to change without notice.

We reserve the right to:
• Limit quantities purchased
• Refuse or cancel orders
• Correct pricing errors
• Discontinue products
• Cancel orders affected by inventory inaccuracies

If an item becomes unavailable after purchase, we may cancel the affected item and issue a refund, store credit, or other remedy at our discretion.

SECTION 4 – ORDER ACCEPTANCE

Receipt of an order confirmation does not constitute acceptance of an order. We reserve the right to cancel or refuse any order for fraud prevention, inventory issues, pricing errors, suspected resale activity, or any other legitimate business reason.

SECTION 5 – RETURNS, EXCHANGES & STORE CREDIT

Returns and exchanges are governed by our published Return Policy.

Approved returns are eligible for store credit only unless otherwise required by law.

Store credit:
• Is non-transferable
• Has no cash value
• Cannot be redeemed for cash except where required by law
• May not be resold
• May be revoked if obtained fraudulently

Items purchased using store credit are final sale.

SECTION 6 – GIFT CARDS

Gift cards are non-refundable and cannot be exchanged for cash except where required by law.

Shop Israella is not responsible for lost, stolen, damaged, or unauthorized use of gift cards.

SECTION 7 – ACCURACY OF BILLING INFORMATION

You agree to provide current, complete, and accurate account, billing, payment, and shipping information.

SECTION 8 – SMS MARKETING TERMS

By opting into Shop Israella text messaging, you expressly consent to receive recurring automated marketing text messages regarding products, promotions, events, sales, and updates.

Consent is not a condition of purchase.

Message frequency varies.

Message and data rates may apply.

To opt out, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.

For help, reply HELP or contact customer service.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging opt-in data and consent information will not be shared with third parties except service providers necessary to operate our messaging program.

SECTION 9 – EMAIL MARKETING

By subscribing to our email list, you consent to receive promotional and transactional communications. You may unsubscribe at any time using the unsubscribe link provided in our emails.

SECTION 10 – USER GENERATED CONTENT

If you submit reviews, photographs, testimonials, comments, social media content, videos, or other content to Shop Israella, you grant us a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, publish, distribute, and display such content for marketing, advertising, and promotional purposes.

SECTION 11 – INTELLECTUAL PROPERTY

All content on this Site, including logos, trademarks, images, graphics, text, videos, designs, and other materials, is the property of Shop Israella or its licensors and may not be copied or used without permission.

SECTION 12 – THIRD-PARTY SERVICES

We may utilize Shopify, payment processors, shipping carriers, analytics providers, SMS providers, email providers, and advertising partners. We are not responsible for the practices of third-party providers.

SECTION 13 – PROMOTIONS & DISCOUNTS

Promotional offers may be modified, suspended, or canceled at any time.

Discounts cannot be combined unless specifically stated.

Products discounted 30% or more may be designated final sale.

SECTION 14 – PROHIBITED USES

You may not:
• Violate any law
• Commit fraud
• Upload malicious code
• Harvest customer information
• Interfere with Site security
• Misrepresent your identity
• Resell products without authorization

SECTION 15 – DISCLAIMER OF WARRANTIES

The Site, products, and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Shop Israella shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site, products, or services.

SECTION 17 – CHARGEBACKS & PAYMENT DISPUTES

Before initiating a chargeback or payment dispute, customers agree to contact Shop Israella and make a good-faith effort to resolve the issue.

Fraudulent chargebacks may result in account restrictions, order cancellation, collections activity, or legal action where permitted by law.

SECTION 18 – INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Shop Israella, its owners, employees, contractors, affiliates, and agents from claims arising out of your violation of these Terms.

SECTION 19 – ARBITRATION

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in Clark County, Nevada, except where prohibited by law.

Each party waives the right to participate in a class action lawsuit or class arbitration.

SECTION 20 – GOVERNING LAW

These Terms shall be governed by the laws of the State of Nevada without regard to conflict of law principles.

SECTION 21 – SEVERABILITY

If any provision is found unenforceable, the remaining provisions shall remain in effect.

SECTION 22 – CHANGES TO TERMS

We may revise these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.

SECTION 23 – PRIVACY POLICY

Your use of our Site is also governed by our Privacy Policy.

SECTION 25 – SHIPPING & DELIVERY

Delivery dates provided by Shop Israella or shipping carriers are estimates only and are not guaranteed.

Shop Israella is not responsible for shipping delays caused by weather, carrier delays, incorrect addresses provided by the customer, customs delays, natural disasters, labor disruptions, or circumstances beyond our control.

Ownership and risk of loss transfer to the customer upon delivery of the package to the shipping carrier.

Customers are responsible for providing accurate shipping information. Orders returned due to an incorrect or incomplete address may be subject to additional shipping charges.

SECTION 26 – LOST, STOLEN, OR MISSING PACKAGES

Once a package has been marked as delivered by the shipping carrier, Shop Israella is not responsible for lost, stolen, or missing packages.

Customers are encouraged to contact the shipping carrier directly to file a claim.

At our sole discretion, we may assist customers in filing carrier claims but are not obligated to replace, refund, or provide store credit for packages confirmed as delivered.

SECTION 27 – IN-STORE PICKUP

Customers selecting in-store pickup will receive notification when their order is ready for pickup.

Government-issued identification may be required at pickup.

Orders not picked up within 30 days of notification may be canceled and converted to store credit at Shop Israella's discretion.

SECTION 28 – RETAIL STORE PURCHASES

Purchases made at Shop Israella retail locations are subject to the Return Policy in effect at the time of purchase.

Original receipts may be required for returns, exchanges, or store credit.

Shop Israella reserves the right to limit or refuse returns that appear excessive, fraudulent, or abusive.

SECTION 29 – REWARDS, LOYALTY PROGRAMS & PROMOTIONAL CREDITS

Any loyalty, rewards, referral, birthday, promotional, or store credit programs offered by Shop Israella may be modified, suspended, or terminated at any time without notice.

Rewards, promotional credits, and loyalty benefits:

• Have no cash value
• Are non-transferable
• May not be sold
• May expire according to the terms of the applicable program

Shop Israella reserves the right to revoke rewards or promotional credits obtained through fraud, abuse, or violations of these Terms.

SECTION 30 – SOCIAL MEDIA CONTESTS & GIVEAWAYS

From time to time, Shop Israella may conduct contests, sweepstakes, giveaways, or promotions through social media platforms or other channels.

Each promotion may be subject to separate rules and eligibility requirements.

By participating in any promotion, entrants agree to comply with the applicable rules and the decisions of Shop Israella, which shall be final.

Social media promotions are not sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, Pinterest, or other social media platforms unless expressly stated otherwise.

SECTION 31 – RIGHT TO REFUSE SERVICE

Shop Israella reserves the right to refuse service, cancel transactions, restrict access to services, remove customers from promotional programs, or prohibit future purchases when, in our sole discretion, a customer engages in:

• Fraudulent activity
• Excessive returns
• Chargeback abuse
• Harassment of employees or customers
• Threatening behavior
• Violation of these Terms
• Misuse of promotions, discounts, or rewards programs

SECTION 32 – FORCE MAJEURE

Shop Israella shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, weather events, natural disasters, pandemics, labor disputes, government actions, utility failures, transportation interruptions, cyberattacks, or disruptions affecting suppliers or carriers.
